A court judgment is only the first step. If the debtor refuses to pay, creditors can initiate execution proceedings to seize or garnish the debtor's assets.

Enforcement Process

  1. Apply for a writ of execution from the court (within 10 years of final judgment)
  2. Asset search — locate all attachable property
  3. Seizure or garnishment order via the Legal Execution Department
  4. Public auction — proceeds applied to the debt

Attachable Assets

  • Real property — house, land, condominiums
  • Salary — up to 30% after living expenses
  • Bank accounts — all accounts at any bank
  • Vehicles and vessels
  • Shares and securities
