Won the Case But Still Unpaid? Enforcement Is the Next Step.
A court judgment is only the first step. If the debtor refuses to pay, creditors can initiate execution proceedings to seize or garnish the debtor's assets.
Enforcement Process
- Apply for a writ of execution from the court (within 10 years of final judgment)
- Asset search — locate all attachable property
- Seizure or garnishment order via the Legal Execution Department
- Public auction — proceeds applied to the debt
Attachable Assets
- Real property — house, land, condominiums
- Salary — up to 30% after living expenses
- Bank accounts — all accounts at any bank
- Vehicles and vessels
- Shares and securities
