Frequently Asked Questions

A government agency ordered my building demolished. Can I sue?
Yes. First file an appeal against the order. If you are not satisfied with the result, file a case in the Administrative Court within 90 days.
Can I sue a government agency for damages?
Yes. If a government official acts unlawfully and causes you loss, the state is liable under the Act on Liability for Wrongful Acts of Officials.
How many days do I have to file in the Administrative Court?
It depends on the type of case. A claim to revoke an administrative order generally must be filed within 90 days of when you knew or should have known of the grounds (s.49), and if the order did not state how and when to sue, the period may be extended to 1 year (s.50). A tort claim must be filed within 1 year, and an administrative-contract claim within 5 years, of when you knew or should have known of the grounds, but no later than 10 years after the grounds arose (s.51). Cases about the public interest or a person's status can be filed at any time (s.52). A lawyer will check the deadline for your case.
