Frequently Asked Questions

What is the deadline for an appeal?
An appeal must be filed within 1 month of the reading of the trial court's judgment, and a Supreme Court (Dika) appeal within 1 month of the reading of the Court of Appeal's judgment. In civil cases, a Supreme Court appeal needs the Supreme Court's permission: you file a petition for leave together with the Dika appeal within that same period. The court may extend the deadline if there is good reason.
Will I win if I appeal?
The Court of Appeal reviews both facts and law. Your chance of success depends on how strong your arguments are. A lawyer will assess the strengths of the case before advising you.
Can every case be appealed?
Not every case. In a civil case where the amount in dispute on appeal is 50,000 baht or less (or not more than an amount set by Royal Decree), you cannot appeal on questions of fact. In some criminal cases with lower penalties, appeals on questions of fact to the Court of Appeal or the Supreme Court may be barred, and a civil Supreme Court appeal needs the Supreme Court's permission.
